Is this the tree that cheated death? We are standing before the Treaty Oak, a majestic Texas live oak and the last survivor of the Council Oaks. This isn’t just any tree. It has witnessed centuries of history and even survived a poisoning attempt. Before European settlers arrived, the Council Oaks served as a sacred meeting ground for the Comanche and Tonkawa tribes. Legend claims Hasinai women brewed a tea from the acorns and leaves, believing it would ensure their warriors’ safety in battle. While history primarily remembers this tree as the “Treaty Oak,” linking it to Stephen F. Austin’s treaty negotiations, no historical evidence supports this claim. Nevertheless, the name stuck. The Treaty Oak faced its biggest threat in 1989 when someone decided to poison it with Velpar, a potent herbicide. The amount used could have killed 100 trees. The community was devastated. News of the “tree poisoning” spread nationwide, and people sent get-well wishes and even chicken soup. The vandal, Paul Cullen, was eventually caught and sentenced to prison. Against all odds, the Treaty Oak survived, thanks to the efforts of dedicated arborists and perhaps a bit of the magic some believe it holds. Today, it stands as a symbol of resilience, a living testament to the power of nature and community.
