Originally built in 1899, this three-story structure initially housed the Shanghai Medical Instruments Factory. Yet its destiny took a sharp turn in the tumultuous 1920s. Shanghai was a city of international intrigue, with the International Settlement operating under its own unique legal system. The Mixed Court, a blend of Chinese and foreign jurisdiction, proved increasingly contentious. Amidst rising tensions, the Mixed Court was abolished in 1926, giving way to the Shanghai Provisional Court. This Former Provisional Court building became the stage for a new act in Shanghai’s legal drama. Here, under the watchful eyes of both Chinese judges and foreign deputies, cases impacting the International Settlement were heard. Imagine the courtroom echoing with arguments, the clash of legal systems, and the weight of international scrutiny. A key feature of the Provisional Court was its appellate process. For certain criminal cases and those involving mixed jurisdictions, appeals would be heard by a Court of Appeal. The President of the Provisional Court actually wore two hats, also serving as the President of this appellate body. The agreement establishing the Provisional Court was meant to be temporary, a three-year trial run. It allowed for the Chinese Central Government to negotiate a permanent solution with foreign powers. This “provisional” arrangement ended up lasting much longer, a testament to the complex web of international relations in Shanghai.
