Established in 1876 during the colonial era it served as the highest tribunal in the Gold Coast. Imagine legal scholars arguing cases under British rule. Back then appeals went to the Judicial Committee of the Privy Council in London.

Fast forward to Ghana’s independence. The Supreme Court became a truly Ghanaian institution. In 1960 Ghana ended appeals to London. This solidified the court’s place as the final legal authority.

However the path hasn’t always been smooth. Military coups led to periods of abolition and reinstatement. The National Liberation Council abolished the Supreme Court in 1966. Later the National Redemption Council did the same in 1972. These actions reflected the political turmoil of those times. Each time the court was revived it reaffirmed the importance of justice.

The 1992 constitution guarantees the independence of Ghana’s judiciary. This separation of powers ensures the court can operate without political interference. The Supreme Court’s decisions shape the legal landscape of Ghana.

The Supreme Court consists of the Chief Justice and at least nine other justices. The President appoints the Chief Justice. This is done in consultation with the Council of State and with Parliamentary approval. Other justices are appointed similarly. The Judicial Council also gives advice.

The Supreme Court’s role is diverse. It interprets the constitution. It handles presidential election disputes. It hears appeals from lower courts. The 2012 presidential election petition highlights its importance. The court upheld President John Dramani Mahama’s election. This showed the court’s dedication to electoral integrity.

One notable case involved Ken Kuranchie. He was the editor of the Daily Searchlight newspaper. In 2013 he was jailed for calling the justices hypocritical. This highlights the court’s power to protect its integrity.

In 2022 parliament passed a bill allowing cannabis cultivation. In 2023 the Supreme Court struck down the bill. Five justices voted against it. Four justices voted for it. This shows the court’s role in shaping legislation.

The Supreme Court has seen many changes since its establishment. Sir David Patrick Chalmers was the first Chief Justice in 1876. Gertrude Torkornoo is the current Chief Justice since 2023. She is one of 27 chief justices who have served.

The Martyrs of the Rule of Law are remembered each year. Three High Court judges and a retired army officer were murdered in 1982. They were killed for their commitment to justice. Their sacrifice is commemorated on Martyrs Day.
