The Finanzgericht Baden-Württemberg is Baden-Württemberg’s sole court for financial jurisdiction. While its main seat is in Stuttgart, Freiburg houses one of its external senates. For a time, these courts weren’t fully independent. They were tied to the financial administration. Judges also worked within the financial administration. It wasn’t until 1958 that Baden-Württemberg established an independent financial judiciary. This pivotal change ensured impartiality.

In 1966, a significant change occurred. The Finanzgericht Baden-Württemberg was formally established with its seat in Karlsruhe. However, external senates operated in Freiburg and Stuttgart. This setup was officially enacted on April 7, 1966.

Initially, the court comprised six senates. One was in Karlsruhe. Two external senates were located in Freiburg and three in Stuttgart. Back then, they handled 1,122 cases. Over the decades, the workload increased. The court expanded to 14 senates. Four were in Karlsruhe, six in Stuttgart and four here in Freiburg.

In 2005, the court’s headquarters moved to Stuttgart. By 2008, the Karlsruhe location closed completely. Today, the Finanzgericht Baden-Württemberg operates solely from Stuttgart and Freiburg. Freiburg currently hosts four senates. This includes the Zollsenat, specializing in customs matters.

The Finanzgericht’s structure reflects Germany’s two-tiered system of financial jurisdiction. As an upper state court, it acts as the primary court of appeal. The Bundesfinanzhof in Munich is the supreme court, overseeing its decisions.

A recent case highlights the court’s ongoing significance. In June 2024, the Finanzgericht Baden-Württemberg ruled on the constitutionality of the state’s property tax law. These judgments, concerning the Landesgrundsteuergesetz, demonstrate the court’s active role in shaping financial law.
