Justice, in its purest form, stands tall here at The supreme Court in Bangkok. This is the highest Thai court. Its decisions shape the legal landscape of the entire country. Judgments from The supreme Court are final.

Let’s delve into the history of The supreme Court. Thailand didn’t always have a formal Supreme Court. In earlier times, the Thai monarch served as the ultimate judge. Citizens could directly appeal to the King. This changed during the reign of King Rama V.

King Rama V established an official department for appeals within the Palace. In 1891, he created the Ministry of Justice. The Judicator Act of 1909 formally established The supreme Court. No longer were cases directly appealed to the king.

Thailand transitioned to a democratic government in 1932. The Judicator Act of 1934 then amended the previous act. Courts were divided into three levels. These levels were the Court of First Instance, the Court of Appeals, and The supreme Court.

The supreme Court acts as the final court of appeal. This applies to all civil and criminal cases in Thailand. No further appeals are possible after a ruling by The supreme Court. Anyone challenging a lower court’s decision can appeal to The supreme Court. They must follow specific legal conditions.

Specialized laws allow direct appeals to The supreme Court. These laws cover labor, tax, intellectual property and international trade.

The supreme Court consists of a president, vice presidents, a secretary, and justices. The president of The supreme Court also leads the Courts of Justice. A minimum of three justices forms a quorum for court proceedings. The Supreme Court divides its justices into 25 quorums internally. The most senior justice in each quorum presides over it.

The supreme Court has specialized divisions. These divisions handle specific types of cases. They include juvenile and family law, labor law and tax law. There are also divisions for intellectual property, international trading, and bankruptcy. The Criminal Division of Holders of Political Positions is another specialized area. Divisions also exist for commerce and economy, environmental issues, and consumer protection. Finally, there is a division for election cases.

Specialized divisions consist of nine justices each. The president of The supreme Court assigns these justices. A chief justice supervises each division. Decisions are made by a majority vote. Justices provide written opinions and oral statements before voting.

Appeals to The supreme Court undergo an administrative review. The president assigns cases to justices individually. This process usually takes about 15 days. Priority is given to special cases. These include intellectual property, tax, and bankruptcy. Criminal cases involving defendants in custody also receive priority.

During adjudication, The supreme Court allows both sides to present their arguments. This process can take months. It depends on the senior judges’ decisions. A draft judgment is then released. The Research Division examines it. Specialized divisions may also review it. This review can take up to a month. Finally, the case file with the judgment is sent to the Court of First Instance. There, the judgment is officially pronounced.

The supreme Court stands as a pillar of justice. Its history reflects Thailand’s evolving legal system. The court ensures that laws are fairly and consistently applied across the kingdom.
