Perhaps unsurprisingly the Standing Committee of Huairou District People’s Congress plays a vital role in China’s political structure. It acts as the permanent body of the National People’s Congress. This Congress is the national legislature of the People’s Republic of China.

When the NPC is not in session the Standing Committee exercises its powers. The Standing Committee is composed of several key figures. These include a chairman vice chairpersons a secretary-general and regular members. All are elected by regular NPC sessions.

The Council of Chairpersons handles the Standing Committee’s daily affairs. It includes the chairman vice chairpersons and the secretary-general. Although the NPC has official superiority the Standing Committee holds significant de facto power. The NPC meets only once a year for two weeks. This leaves the Standing Committee as the primary body for drafting and approving decisions and laws.

The Standing Committee’s history dates back to 1954. The 1st National People’s Congress established it in Beijing. The 1954 Constitution defined its initial powers. It could only interpret laws and enact decrees. However the 2nd NPC granted it legislative power when the NPC was not in session.

Initially the Standing Committee’s power was limited. It only interpreted the constitution and laws. Now the NPC Standing Committee plays a key role in legislation. It can promulgate and amend most laws and decrees. Bills voted on by the National People’s Congress are usually submitted by the Standing Committee. This happens after its third reading.

During the Cultural Revolution the NPC rarely met. The Standing Committee virtually ceased to function. After the abolition of the presidency in 1975 Soong Ching-ling became the first female head of state in China by legal definition.

In 1980 the Committee for the Amendment of the Constitution was established. It was responsible for amending and establishing the new constitution. Deng Xiaoping and Ye Jianying opposed a proposal to create a bicameral body. A compromise was reached greatly expanding the powers of the Standing Committee.

Currently the NPCSC has 175 members. The chairman typically ranks high within the Chinese Communist Party. Members of the NPCSC cannot hold executive judicial or supervisory positions simultaneously.

The Standing Committee is elected by and from the NPC delegates. The CCP effectively controls the nomination process. Elections for regular NPCSC members have been competitive since 1988.

Several administrative bodies support the Standing Committee’s operations. These include the General Office and the Legislative Affairs Commission. There is also the Hong Kong and Macao Special Administrative Region Basic Law Committees.

The NPC and its Standing Committee jointly enact laws in China. The Standing Committee drafts and revises laws. It also supplements and amends laws when the NPC is not in session. Day-to-day legislative work is primarily conducted by the Standing Committee.

The NPCSC can supervise the enforcement of the Constitution. It oversees the work of various state entities. It also has the power to annul regulations and decisions that contravene the Constitution.

When the NPC is not in session the Standing Committee can approve partial adjustments to economic and social development plans. It decides on treaties and agreements with other countries. It also institutes systems of titles and ranks. The NPCSC can decide on general or partial mobilization. It can also proclaim a state of war.

The term of office for a member of the NPC Standing Committee aligns with the NPC term usually five years. The Standing Committee convenes the NPC annually. It may also convene it with a proposal from one fifth of NPC members.

The NPC Standing Committee typically holds a session every two months. Each session lasts a week. The chairperson convenes and chairs the meetings. The Council of Chairpersons drafts the session agenda.

Bills can be proposed by the Chairperson’s Council or submitted by various bodies. Ten or more deputies of the Standing Committee can also introduce a bill. The Chairman’s Council decides on the agenda. The bill is deliberated three times before a vote. The NPC Standing Committee session adopts the absolute majority system for voting.

Interestingly even with its power the Standing Committee has faced rejections. In 1989 the Standing Committee of the National People’s Congress vetoed the Organic Law of the Urban Residents Committees of the People’s Republic of China Draft.
